Who(m), placed the image on the site?
The site owners or the user?
I’m not sure I understand your question. On the photographer’s website or Pinterest? If you are talking about the photographer’s website, then the photographer placed the image on the site. As for Pinterest, the user is the one who ‘pinned’ the image from the photographer’s website onto Pinterest.
The issue above in my opinion encompasses two aspects: copyright and contract. The copyright liability at minimum falls on the Pinterest user based on Pinterest’s TOS. However, there arguably is breach of the written contract between the photographer and the magazine, the question then becomes who is liable for that breach.
